Chatham County publishes a detailed excess-funds process and expressly states that claimants are to submit their own requests directly.

Last reviewed: October 6, 2026. County procedures can change. Verify the county's current instructions before filing. EquityTrace is a private recovery-services company, not a government agency or law firm.

Who Chatham identifies as possible claimants

The county lists the property owner at the time of the tax sale, an heir or beneficiary if the owner was deceased, and a lienholder or other party with a legal claim against the property as examples of parties who may request excess funds.

Third-party representation

Chatham's current page says the Tax Commissioner's office does not correspond with third parties or recognize a legal relationship of representation by an asset recovery firm or by a person or company holding a power of attorney. It instructs claimants to submit requests directly.

Submission and review

The county says claimants should complete its Excess Funds Request Form, gather the documents listed on the form, and submit by mail or email. Chatham states that most reviews take about three to four weeks, while complex claims can take longer.

Conflicting claims

Chatham states that multiple or conflicting claims, or claims that cannot be verified, may be interpleaded in Superior Court.
