Gwinnett County's Tax Commissioner publishes a dedicated Tax Sale Excess Funds page with the current list, claim forms, submission instructions, and an explanation of who may claim.

Who Gwinnett says may claim

Gwinnett cites O.C.G.A. § 48-4-5 and states that claims may be made by the record owner at the time of sale, the record owner of each security deed affecting the property, and other parties with a recorded equity interest or claim at the time of sale.

Use the county's unaltered claim form

Gwinnett states that claim forms must be completed in their entirety and returned in an unaltered state. Incomplete or altered forms will not be accepted.

No third party is required

The county expressly states that a claimant is not required to pay or be represented by a third party in order to claim excess funds.

Legal review and competing claims

Gwinnett says claims may be sent to the County Law Department for review and research when appropriate. If more than one claim is received, a judge may determine who receives the funds.
