Clayton County's official excess-funds claim form lists different supporting documents depending on whether the claimant is a property owner, lienholder, security-deed holder, or estate representative.

Last reviewed: October 6, 2026. County procedures can change. Verify the county's current instructions before filing. EquityTrace is a private recovery-services company, not a government agency or law firm.

Property owner

The official form instructs a property owner to provide a warranty deed or other deed demonstrating ownership together with a Certificate of Title dated within 60 days of the request and showing the property free and clear of mortgages or liens. The form says a request without the Certificate of Title will not be considered.

Lienholder or security-deed holder

A lienholder is instructed to submit a copy of the filed lien with a current balance statement. A security-deed or mortgage holder is instructed to submit the recorded security deed with a current balance statement.

Executor or administrator

An executor or administrator is instructed to provide Letters Testamentary or another court document showing appointment together with the decedent's death certificate.
