DeKalb County's published excess-bid claim form is unusually specific about who may submit a claim and what form the demand should take.

Last reviewed: October 6, 2026. County procedures can change. Verify the county's current instructions before filing. EquityTrace is a private recovery-services company, not a government agency or law firm.

DeKalb's published claim form

The county's Petition to Demand Payment of Excess Bid asks for the parcel, property address, sale information, claimant identity, and the amount claimed. For secured-party claims it also requires information about the secured interest and its priority.

Notarization and entitlement

The form states that signatures must be notarized and that claims are evaluated case by case using the submitted documents and other information available to the Tax Commissioner.

Representation rule to verify before filing

The current county-hosted form states that claims must be made by the party entitled to receive the funds or by a bona fide attorney licensed to practice in Georgia, and that powers of attorney are not acceptable. Because procedures can change, confirm the current form before relying on this requirement.

Interpleader

The form also states that the Tax Commissioner may file an interpleader with Superior Court for determination of entitlement.
