Henry County's current procedure differs materially from many Georgia counties: the Tax Commissioner's office states that it interpleads all tax-sale excess funds to the Clerk of Superior Court and does not distribute those funds itself.

Where the funds go

Henry County states that all excess funds from its tax sales are interpleaded to the Clerk of Superior Court. The Tax Commissioner's office says it does not hold or distribute the funds.

How a claimant pursues funds

The county states that an interested person must file a motion in Civil Court. After filing, the claimant must wait for a judge to review the matter and determine eligibility. If the judge orders disbursement, Civil Court processes the check.

No county claim form or legal advice

Henry County states that the Tax Commissioner's office, Clerk of Superior Court, and Civil Court do not provide forms for filing for the funds and do not provide legal advice.

Availability caution

The county also warns that its excess-funds list is not updated to verify whether a listed balance is still available. Current availability therefore needs separate verification.
